1. Purpose

This Fair Use Policy outlines the principles and guidelines governing the use of copyrighted works, proprietary materials, and confidential information made available through the Services in conjunction with the Oxygen Finance Subscription Terms and Conditions, as issued and updated by Oxygen Finance Limited (Oxygen Finance) from time to time at https://www.oxygen-finance.com/online-service-subscription-terms-of-service/.  It seeks to balance the permitted and lawful use of such materials with the rights of the copyright owners, ensuring the protection of intellectual property while allowing limited use in certain circumstances for legitimate purposes.

Terms defined in the Oxygen Finance Subscription Terms and Conditions shall have the same meaning when used in this Fair Use Policy unless the context permits otherwise.

2. Scope

This Fair Use Policy applies to Customers and all Authorised Users (Users) who access and use the Services and access, use, or share copyrighted works, proprietary materials, or confidential information owned or licensed by Oxygen Finance and/or or its third-party licensors and made available to access and use via the Services (Oxygen Data).

3. Permitted Use

The Customer is licensed to use Oxygen Data for its internal business operations including:

• Internal distribution: Authorised Users may copy and distribute small and insubstantial amounts of the Oxygen Data for the Customer’s internal use provided that the amount of material used is reasonable and proportionate based upon the number of licenses purchased.
• External Distribution: Oxygen Data may be used for external distribution provided that the material is appropriately credited to Oxygen and is consistent with the Prohibited Uses.
• External Publication: Oxygen Data may be used for external reporting, including publication in the news media, provided that the material is appropriately credited to Oxygen Finance and is consistent with the Prohibited Uses.

4. Prohibited Uses

The following activities are prohibited under this Fair Use Policy:

• Commercial Use Without Permission: Using Oxygen Data for commercial purposes (e.g., selling, distributing, or using in marketing materials or otherwise exploiting Oxygen Data) without explicit permission in writing from Oxygen.
• Systematic Copying or Distribution: Systematically downloading, copying or distributing excessive or substantial parts or amounts of Oxygen Data, even for internal use, without the explicit permission in writing from Oxygen.
• Legal Usage: Use of the Oxygen Data in legal proceedings.
• Non Users: The Customer shall not authorise additional users to use the Service, and for the avoidance of doubt, Authorised Users may not on a regular basis, or an irregular but frequent basis, distribute more than a few articles to any persons or individuals who are not Authorised Users.
• Unlawful Use: Use of the Services that is unlawful, illegal, harmful, threatening, defamatory, obscene, infringing, discriminatory, harassing or offensive.

5. Attribution and Acknowledgment

When using Oxygen Data, Users must ensure that the original work and its author or copyright holder are clearly and appropriately credited. Failure to do so may result in a violation of copyright law and breach of the Oxygen Finance Subscription Terms and Conditions.

6. Proprietary Materials and Confidential Information

Oxygen Data may contain proprietary materials or confidential information owned by Oxygen Finance and/or licensors and subject to various laws relating to intellectual property, such as copyright. Any unauthorised use, sharing, or disclosure of such Oxygen Data may result in legal action for breach of such laws as well as breach of Oxygen Finance Subscription Terms and Conditions.

 

7. Consequences of Breach

Violation of this policy, including unauthorised use of Oxygen Data, may result in:

• Legal liability for copyright infringement or breach of intellectual property rights.
• Breach of the Oxygen Finance Subscription Terms and Conditions and legal liability for such breach.
• Suspension or termination of the Customer’s Agreement.

 

8. Review and Amendments

This Fair Use Policy is subject to review and may be amended periodically to reflect changes in Oxygen Finance’s policies and practices. Users are responsible for ensuring they are familiar with the most current version of this policy.
